Java Jo’z licensees Mike De Rosa & Sara DeRosa opened a drive-through coffee unit March 21 in the old Wal-Mart shopping center parking lot in Spring Lake, NC. The DeRosas hosted a Grand opening ribbon-cutting ceremony May 5.

The 260-square-foot hut offers two drive-through windows and a single walk-up window. Future plans include outdoor seating areas.

Licensees:  Mike De Rosa is retired from the military, and his wife & Sara is serving in the Army. The husband and wife team have been married for four years.

Marketing:  The DeRosa’s are planning to promote through the use of pre-paid, rechargeable gift cards. If a customer puts $25 on a reloadable card, they will make it $30 or give the customer a free large drink. They plan to market the Java Jo’z cards as gift cards as well. 

They also plan community marketing such as sponsoring a local baseball team and hold fund-raising nights for local schools.  They offer 10 percent military, senior, teacher, student and first-responder discounts on select days.

Products and Pricing:  The Java Jo’z location offers hot coffee drinks in a variety of flavors, from traditional cafe lattes, Chai tea lattes and mochas. Prices range from $1.75 to $4, depending on the style of drink and size. Syrup flavors, including vanilla, caramel, raspberry and Irish cream, can be added to drinks for 50 cents. 

Frozen drinks are sold for $3.75 for a medium or $4.25 for a large, and include mochaccino, caramel mochaccino and frozen hot chocolate. 

Smoothie flavors, at the same cost, include strawberry banana, mango breeze, berry delight and strawberry lime-up.

Snack items, such as biscotti ($1.25), cookies ($1) and cinnamon rolls ($1.50), are also available.

A Cuppy’s Coffee Smoothies & More franchise location is scheduled to open in a new center in Anderson, IN.

Simon Property Group’s Hamilton Town Center, located at Exit 10 on Interstate 69, will open 30 new stores and restaurants Friday, including such franchises as GNC, Massage Envy, Sunglass Hut, and Paradise Bakery.

In addition to the Cuppy’s Coffee Smoothies & More, other food franchises expected to open include Coldstone Creamery franchise, Five Guy’s Burgers and Fries, Houlihan’s, a McAlister’s Deli franchise, Noodles & Company, Qdoba Mexican Grill, and Red Robin.

A new Cuppy’s Coffee franchise will open in Raleigh, North Carolina. Cuppy’s Coffee is expected to open in the new Raleigh’s Forestville Crossing at Louisburg and Forestville roads. The coffee franchise is expected to open in Summer, 2008. ProClips and Roadrunners Pizza will also open this summer.

Cuppy’s Coffee, Smoothies & More has opened a new franchise location in Des Moines. Cuppy’s is a new double-sided drive-through coffee shop that opened at 400 S.W. Seventh St., Des Moines, south of Martin Luther King Jr. Parkway. The Cuppy’s Coffee franchise owners are newlyweds Brian and Kim Burgett

The new Cuppy’s Coffee features coffee and espresso drinks, fruit smoothies, iced and hot tea, chai and chai lattes. Muffins will be available in the morning, and eventually sandwiches will be available. Price ranges are $3.75 and $4.25 for small and large smoothies and mochaccinos, and $2.55 to $3.95 for coffee drinks. Hours are 6 a.m. to 6 p.m. Mondays through Saturdays and 7:30 a.m. to 2:30 p.m. Sundays. Coffee is by Caffee D’arte, and syrups are by Ghirardelli and Monin.

A new Cuppy’s Coffee franchise will open in Ohio.  Cuppy’s Coffee is expected to open in the new Sterkel Park shops in Mansfield, OH.  The coffee franchise is expected to open in late June or early July, 2008.  Rise & Dine Restaurants recently opened in the center and four other merchants are finishing construction within the next two months, including Comfrey Corner Natural Foods.

The Kearney Hub reports that the “referee” overseeing disciplinary proceedings against Kearney, Nebraska attorney Jeff Orr is blowing the whistle on Orr, and giving him a 15 yard penalty for impersonating a franchise attorney.

In 2002, Barista’s owners Sickler and Mettenbrink hired Orr to assist them in franchising their 1 1/2 year old coffee shop concept. Orr told Sickler and Mettenbrink that he had franchise legal experience. His experience, however, was limited to having read a handful of disclosure documents. He as much as admits that he copied the Quizno’s franchise agreement.

Here are some highlights from the Kearney Hub article:

“…Orr took on the Barista’s case knowing he was not competent to handle the work. “Not only had he never undertaken such a task previously, but also he was warned by an intellectual properties lawyer, whom he respected, that franchise law is ‘pretty specialized,’”

“… Although he knew that certain aspects of franchising were governed by the Federal Trade Commission, he did not adequately prepare himself for the task,” Olson said of Orr.

“Before learning that their disclosure statement did not comply with FTC rules, Barista’s sold 21 franchises between 2003 and 2006. Barista’s Daily Grind currently operates in west Kearney under new ownership.”

“Barista’s closed its two Kearney locations at 4402 Second Ave. and 2400 Central Ave. last summer after Sickler and Mettenbrink defaulted on loan payments and lost ownership of their properties to Kearney State Bank & Trust Co. in a foreclosure.”

“Although the exact nature and extent of the harm suffered by the clients was not addressed in detail, the evidence is clear and convincing that the consequences to the client were serious,” Olson said.

“Waldine Olson, who is acting as referee in Orr’s disciplinary proceedings, has ruled that Orr violated four of 13 ethical standards and provisions listed in the State Bar Association’s Code of Professional Responsibility and Rules of Professional Conduct.
